1. Agreement to Terms
By accessing and using the Growth Spark Studio website and services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services. These terms apply to all visitors, clients and others who access our services.
2. Services
Growth Spark Studio provides digital growth services including graphic design, web and app development, digital marketing, outbound marketing and business automation. The specific scope of services for each client is defined in individual service agreements or proposals.
3. Payment Terms
Payment terms are defined in each client agreement. Generally, invoices are due within the timeframe specified in the agreement. Late payments may incur interest charges. We reserve the right to suspend services for overdue accounts.
4. Intellectual Property
Upon full payment, clients receive rights to deliverables as specified in their agreement. Growth Spark Studio retains rights to underlying tools, frameworks and methodologies used in delivering services. We may use project deliverables in our portfolio unless otherwise agreed in writing.
5. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the engagement. For white label partnerships, we sign a separate NDA before any work begins.
6. Limitation of Liability
Growth Spark Studio's liability is limited to the amount paid for the specific service in question. We are not liable for indirect, consequential or incidental damages. We do not guarantee specific results as outcomes depend on multiple factors including market conditions and client cooperation.
7. Termination
Either party may terminate an engagement with appropriate notice as specified in the service agreement. Upon termination, all completed work product that has been paid for will be delivered to the client.
8. Governing Law
These Terms are governed by the laws of India. Any disputes will be resolved under the jurisdiction of courts in Ahmedabad, Gujarat, India.
9. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of updated terms.
